- The Emergency rules were challenged in court with an official lawsuit where an injunction was not permitted; ultimately, no changes were made to the emergency rules and its legality/legitimacy.
- The 2024 Farm Bill was postponed/rescheduled to next year, meaning there are no immediate changes to hemp or THCa on the federal level.
The biggest change is that Final Rules have now been posted, which does contain a limit on the amount of THCa allowed in an HDC product. Pertaining to a legal HDC Product with THCa, the language reads: "showing a post decarboxylation THC value less than or equal to 5%".
Near Future
The months of October, November and December are likely to consist of massive quantities of sales for THCa Flower, Vapes, and Concentrates. Businesses are likely to drain their inventory of what will be non-compliant products before the deadline. They will also prepare for stricter regulations including routine inspections from the Department of Agriculture and or Department of Revenue. Because of the criminal penalties the company would bear for selling illegal products, we are likely to see the standards raise amongst the legal THC retail market in Tennessee.
Is it Guaranteed that THCa is Banned?
As of October 1st, 2024 when the Final Rules were published, the handwriting is on the wall. The Final Rules also contain answers to all of the public comments submitted within the allotted period over a year ago. The only scenario where THCa is not banned, would be in the case of a successful lawsuit. This would be headed by the TN Growers Coalition and their attorneys who would need to act more efficient than last time. If there ever was a time to support, the time is now!
