THCa and THCp in Imminent Danger | Tennessee 2025

Previously, THCa was on the legal chopping block in the State of Tennessee. Ultimately, the ruling to regulate compliant products by the Total THC standard has been postponed to June 5th 2025. Right now, the industry is facing 2 doomsday bills which will have the most debilitating effects ever considered:

HB1376/SB1413 and HB1148/SB1236 are the latest introductions from the Tennessee Bureau of Investigation (TBI) and Alcoholic Beverage Commission (ABC) with extremely deleterious effects on the legal cannabis industry in TN.

HB1376/SB1413

ABC Control & Licensing:

The ABC would regulate all HDC products, requiring suppliers, wholesalers, and retailers to obtain costly annual licenses.

THCa Ban:

The bill bans the manufacture, sale, or possession of any product containing more than 0.1% THCa, effectively eliminating THCa flower from the market.

Retail & Sales Restrictions:

HDC products could only be sold in licensed establishments, banning sales in grocery stores and convenience stores. Online and direct-to-consumer sales would also be prohibited.

Three-Tier System:

The bill establishes a distributor-controlled system similar to alcohol, which could increase costs and limit market competition.

Stricter Product Testing & Packaging Rules:

Requires full-panel lab testing, strict packaging standards, and child-resistant packaging.

New Taxes & Fees:

A new wholesale tax of $0.01 per milligram of hemp-derived cannabinoids, on top of the existing 6% privilege tax.
